1. Client agrees that by placing an order either by means of electronic ordering (web order form) or submitting a written contract, and receipt of such order by nForced Website Hosting Limited, that you are agreeing to our TOS and SLA. No Modifications of said contract by the client is allowed.
2. nForced Website Hosting Limited will provide, and Customer will purchase and pay for any services purchased via our website. Customer acknowledges that the service, and service fees have been communicated to the customer, and that they are aware of all applicable charges as per contract, Terms of Service and Service Level Agreement. Customer also understands that any promotional offers unless specified in contractual terms will not be applicable to their individual service.
3. nForced Website Hosting Limited will not under any circumstances accept liability for sickness, stress, injury, loss of earnings, loss of data or failure of computer hardware, software, due to using our services, or advice given by staff.
We strive to make sure our website(s) and management applications are available to our customers at all times, however reserve the right to take them offline at any time. This may include (but not limited to) for maintenance, upgrades, security reviews or digital attack mitigation.
We use a range of tracking applications on our website(s) and management applications where appropriate, we use the information gathered from these internally to nForced Website Hosting Limited for analysis and improving the usability of our systems.

Bandwidth (defined as amount of data used per calendar month) on all our servers is unlimited, however the speed at which you are connected is limited. nForced Website Hosting Limited reserves the right to change the connection speed at any time. This may be to restrict impact on services or to protect our infrastructure.
nForced Website Hosting Limited will make best efforts to ensure every virtual server is connected to a network to provision an Internet Connection, however reserves the right to do so and may at any time withdraw access even if in use.
Hard drive space may differ to the exact plan listing do to many technical implementations of our service. These include (but are not limited to) block device containment, partitioning, filesystem creation, Operating System and pre-installed packages/programs.
In the event of a corrupted filesystem or block device we will attempt to repair, however nForced Website Hosting Limited will not accept any responsibility for data loss.
Swap partitions are provided with each virtual server instance as a temporary "burst" measure to increase the Memory available to the server. Constant high I/O usage of this partition may result in nForced Website Hosting Limted removing it from your service permanently.
Scheduled Downtime is any nForced Website Hosting Limited scheduled interruption of Services, for the purpose of network upgrades, or replacement of any equipment in order to provide for you better service. Scheduled downtime occurs during notified downtime periods, with as much advance warning as possible via Customer account e-mail address held by nForced Website Hosting Limited.
Network Outages or Unscheduled Downtime is any unplanned or unscheduled interruption in Service availability during which the Client is unable to access the services as described in the section titled "Network Uptime" above. A Network Outage is defined as a period in which 100% packet loss to our network is experienced, which is determined to have been caused by a problem in nForced Website Hosting Limited's Network as confirmed by nForced Website Hosting Limited. Downtime or outages are measured as the total length of time of the unplanned interruption in service availability in a calendar month.
Customer can request a percentage refund of their monthly payment back if the server has downtime under of 90% in a calendar month period. This refund will be calculated from the downtime and affected service price, to be calculated by nForced Website Hosting Limited.
Customer must request their refund within 7 days of any downtime.
Performance Credit exclusions: The following are excluded from the monthly calculation of Service Availability: · Scheduled downtime · Problems outside of nForced Website Hosting Limited's network ( upstream providers, or client's inbound connection) not effecting 100% loss to our network · Interruptions or failure of individual service caused by client, their employees, client's customers, etc. to their service. These include inaccurate configuration, 3rd party software, client abuse or over utilization of resources, hacked servers, attacks, exploits, server hardware failures or other users on server to cause the server to overload which may cause downtime. We will do our best to remove such offenders immediately.
IPv4 addresses unassigned and assigned to virtual servers remain the property of nForced Website Hosting Limited and our upstream providers. At no point even if implied is ownership of any IPv4 addresses to be given or transferred to a customer.
nForced Website Hosting Limited will make best efforts to ensure every virtual server is assigned an IPv4 address, however reserves the right to do so and may at any time withdraw access to any IPv4 addresses assigned or unassigned to virtual servers even if in use.
IPv4 addresses may be blocked, removed or partially blocked at any time by our providers or directly by nForced Website Hosting Limited. We will make best efforts to inform customers who have such an address currently assigned to their virtual service.
nForced Website Hosting Limited run a zero tolerance spam policy. Any server detected to be sending out spam or phishing emails will instantly be blocked at the network level. Customers may have their IPv4 address unblocked at the discretion of nForced Website Hosting Limited after following our requests to secure their services. If our IP addresses are blocked for 30 days by our upstream provider(s) your service may be terminated without refund.
We reserve the right to ban the use of applications which allow the proliferation of unsolicited email from our network, or which decrease the performance of our servers thus bearing on the quality of service we may provide to other customers.
Virtual servers may be placed automatically at any time under DDoS mitigation which may cause degraded performance and add latency to the connection. The mitigation placement may outlast the duration of any detected attack by 26 hours or more and service cannot be guaranteed during this placement. Our provider automatically determines and commands the placement and removal of all IPv4 addresses and as such customers accept this is outside both their and nForced Website Hosting Limited's control.
nForced Website Hosting Limited will not under any circumstances accept financial liability for sickness, stress, injury, loss of earnings, loss of data or failure of computer hardware, software, due to using our services, management software, action or advice given by employees of nForced Website Hosting Limited.
nForced Website Hosting Limited may provide a weekly backup of active services, however is under no obligation to restore or ensure the integrity of the backups.
If data loss occurs on nForced Website Hosting Limited services it is the customer's responsibility to restore the data. nForced Website Hosting Limited may offer data restores if a backup was maintained. However nForced Website Hosting Limited will not accept any form of liability if a backup was not maintained or if the restore causes any further loss or corruption of data.
Establishment of this service is contingent upon receipt of payment from Customer to nForced Website Hosting Limited. Subsequent payments are due on the anniversary date of the month for that month's service, unless customer requests all monthly payments to be consolidated to one specific billing date. Any additional services relative to a primary hosting account, will be prorated to the primary hosting account's monthly recurring billing date, along the following guidelines of prorating methodology: (total monthly fees/ 30) * number of days to monthly recurring billing cycle. Any setup fees will be charged full setup fee pricing, and are applied at time of initial request of such services.
nForced Website Hosting Limited may temporarily deny service or terminate this Agreement upon failure of Customer to pay charges when due. Such termination or denial will not relieve Customer of responsibility for the payment of all accrued service fees, or any collection fees.
Payment is due on the defined monthly recurring billing date of each month. Credit cards that are declined for any reason are subject to a £10.00 declination fee. Service will be interrupted on accounts that reach past due date. Service interrupted for nonpayment is subject to a £20.00 reconnect charge. Accounts that are not collectable by nForced Website Hosting Limited will be turned over to an outside agency for collection. If your account is turned over for collection, you agree to pay the company a "Processing and Collection" Fee of not less than Fifty GBP (£50.00) nor more than One Hundred, Fifty GBP (£150.00)
All requests for cancelling any service / services must be made in writing with at least 10 days notice, failure to do so will result in being charged the full months invoice. Cancellation can be done by visiting http://portal.zvps.co.uk > My Products or Services > Cancel. You are responsible for making cancellations to your subscription payments.
Customers are entitled to a refund of any network downtime if proven to be due to the fault of nForced Website Hosting Limited. If the fault is caused by a miss configuration by the Customer, refund entitlement will be refused by nForced Website Hosting Limited.
All payments to nForced Website Hosting Limited are non refundable. This includes any setup fees and monthly fees regardless of usage. All billing disputes must be reported within 30 days of the time the dispute occurred. Disputed charges to your credit card issuer, also known as charge backs, in nForced Website Hosting Limited's discretion which is valid, under the terms and conditions of our SLA and TOS, will result in service interruption, and reconnection fees to restore the desired service.
Special Offers: From time to time, nForced Website Hosting Limited may offer a doubled disk space and bandwidth offer, This is subject to availability and strictly limited to our Virtual Private Servers. nForced Website Hosting Limited reserve the right to withdraw this offer at anytime. Vouchers enabling 50% off or higher do not include any licenses in this promotion, you will be invoiced for this after the order has been place.
nForced Website Hosting Limited will provide access to the zVPS.uk Management Portal to all customers with active virtual servers. Access is to be provided to the customer within the first week of purchasing a service if automated setup fails.
Customers with active services are to keep their contact and billing details up-to-date at all times inside the zVPS.uk Management Portal.
nForced Website Hosting Limited provides automated functions with which customers can manage their virtual services by. This management panel and the functions it provides are provided under best efforts to customers with active virtual services.
Attempting and or gaining access to services or functions on services not assigned to you may result in suspension of your accounts and services with nForced Website Hosting Limited without refund.
Finding of and reporting security holes in our systems may at the discretion of nForced Website Hosting Limited result in a bounty or discount to our services. However attempts to forcefully find or break into our systems may result in suspension of your accounts and services with nForced Website Hosting Limited without refund.
In the event of security flaw(s) being found on any of our systems please report to email@example.com. Please give our team time to investigate and patch before any other form of disclosure takes place.
